The recent ruling from the Constitutional Court of Indonesia has sparked discussions in the telecommunications industry. The decision states that any unused internet quotas purchased by customers cannot expire and must remain usable until fully consumed.
Response from Telecommunications Association
Marwan O. Baasir, the Executive Director of the Indonesian Telecommunications Providers Association (ATSI), expressed support for the ruling. He explained that the ruling essentially requires mobile operators to offer products with a rollover mechanism. This means that any remaining quota can be carried over into the next period.
Current Offerings in the Market
According to Marwan, some mobile operators already provide rollover options. He emphasized that the obligation to offer such products is not new, as it is already present in the offerings of several telecom companies.
Awaited Regulations from the Ministry
Despite the positive feedback regarding the ruling, Marwan pointed out that the actual implementation will depend on the technical regulations set to be issued by the Ministry of Communication and Digital (Komdigi). He stated, “We are currently waiting for the regulations from Komdigi that will detail the technical guidelines following this court decision.”
Details of the Constitutional Court's Decision
The court's decision partially granted a judicial review of Law Number 36 of 1999 on Telecommunications. It mandates that telecom providers must create mechanisms to ensure that purchased internet quotas remain valid and do not expire once the active period ends. The ruling also clarifies that operators should not impose additional fees, such as for extending the validity period, for customers to access their remaining quota.
Furthermore, the court indicated that the mechanism to protect consumer rights regarding unused internet quotas does not need to be implemented in any specific form. Operators have the flexibility to provide various options, including rollover, validity extension, compensation, and other approaches that safeguard consumer rights.
