AliExpress has been found in violation of the EU's Digital Services Act (DSA), which requires online platforms to actively monitor and manage the risks associated with illegal products. The EC determined that AliExpress had overestimated the efficiency of its systems designed to identify and eliminate such items from its marketplace.

Issues with Product Monitoring

According to the EC, AliExpress relied heavily on a single quantitative metric to gauge its moderation effectiveness. This approach proved insufficient in accurately assessing the prevalence of illegal products on its site. The platform's detection system failed to operate effectively, allowing numerous illegal items to remain available for purchase for extended periods, even after they were identified.

Inadequate Enforcement and Compliance Checks

The EC criticized AliExpress for its lack of enforcement when it came to penalizing sellers of illegal goods. The platform's compliance checks were easy to circumvent, allowing sellers to mislabel products and bypass regulations meant to ensure legality. Furthermore, the brand authorization system, which was designed to prevent counterfeit sales, was deemed ineffective and understaffed, failing to deter traders from exploiting the platform.

Next Steps for AliExpress

In light of the fine, AliExpress has been given until October 20 to present an action plan to the EC. This plan must outline strategies to address the shortcomings in its risk assessment and mitigation processes. Following the submission, the European Board for Digital Services will review the plan and provide feedback within a month. The EC will then have an additional month to finalize its decision and establish a timeline for AliExpress to implement necessary changes.

This significant penalty underscores the increasing scrutiny online marketplaces face regarding their responsibility to guard against counterfeit and illegal products. As the e-commerce landscape continues to evolve, companies like AliExpress must enhance their systems to comply with regulatory standards and protect consumers.
